Waste concept and circular economy

The dissertation "Abfallbegriff und Kreislaufwirtschaft" by Patrick Petschinka analyses the development of waste law in Austria in the context of the increasing importance of the circular economy. He analyses how the concept of waste has changed in case law and legislation, what challenges this poses and whether the concept of waste meets the requirements of a sustainable circular economy.

Petschinka describes the change from a waste management system primarily geared towards landfilling to a system that emphasises waste prevention and resource conservation. It emphasises the problem of the blurred distinction between waste and products, which often leads to uncertainties in practice. The dissertation also examines the European legal requirements and their implementation in Austrian law, in particular in the Waste Management Act 2002.

The focus of the work is on a critical examination of the concept of waste and the associated legal consequences. Petschinka discusses proposals for the further development of waste legislation in order to better adapt it to the objectives of the circular economy and promote waste prevention.
